§ 1 Scope
These Terms & Conditions govern all contracts between QuickBau Berlin ("Contractor") and the client for the execution of construction, renovation and related services. Any conflicting terms of the client are not recognised unless the Contractor expressly agrees in writing.
§ 2 Contract Formation
All quotes are non-binding. A contract is formed when both parties sign a written agreement or when the Contractor issues a written order confirmation.
§ 3 Scope of Work & Changes
The scope of work is defined by the written contract or bill of quantities. Additional work beyond the agreed scope is only carried out on the basis of a separate written instruction and invoiced separately.
§ 4 Completion Deadlines
Agreed dates are indicative unless expressly stated as binding. The Contractor is not liable for delays caused by force majeure, adverse weather, material delays or other circumstances beyond its control.
§ 5 Fees & Payment
Invoices are payable within 14 days of the invoice date without deduction. In the event of late payment, statutory interest will be charged.
§ 6 Acceptance
Upon completion, the client must accept the work within a reasonable period. Obvious defects must be reported in writing within 5 working days. After this period, the work is deemed accepted.
§ 7 Warranty
The statutory warranty period under § 634a German Civil Code (BGB) applies. Defects must be notified to the Contractor in writing without delay.
§ 8 Liability
Liability is limited to intent and gross negligence. Liability for minor negligence is excluded, except for breaches of essential contractual obligations.
§ 9 Governing Law & Jurisdiction
German law applies. The place of jurisdiction is Germany.
